MedeHX is aware of the importance of your personal information and how we treat it .We appreciate the trust you place in us to treat it with due rigor and caution. This document details the Privacy Policy and Cookies (the "Privacy Policy") that are in effect at all times, it’s the obligation of the Users to review it periodically to ensure they are complying with it. Access and registration on this website is done in a free way, but implies the express and full acceptance of these Terms and Conditions and Privacy Policy MedeHX. However, MedeHX reserves the right to limit access to certain content or services. If you do not agree to the Terms and Conditions and / or Privacy Policy, please do not register or log in to MedeHX. Present Privacy Policy and Terms and Conditions constitute the entire legal agreement between MedeHX and the user of the website and services.

MedeHX respects and guarantees the implementation and provision of services provided, respect for the rules and procedures provided for in the legislation to protect the rights to personal privacy, protection of personal data, freedom of expression and freedom of information, as they could be affected; and particularly the provisions of Law 15/1999 of 13 December on protection of personal data and Law 41/2002 of November 14, Healthcare Patient and the Rights and Obligations of clinical information and documentation; as may be applicable.

1. TREATMENT OF PERSONAL DATA

www.medehx.com (hereinafter "the website") is owned by MedeHX Health SL, with business address at Calle Moreno Nieto, 2, 28005 Madrid (Madrid), NIF: B87669834 and email address contact@medehx.es ( "MedeHX", "we" or "our").

In compliance with the provisions of Law 15/1999, of December 13, Protection of Personal Data ( “LOPD”), we inform you that:

  • The personal data you provide us through the contact form available on the Web will be included in the file "Web Users" MedeHX responsibility.
  • The personal data you provide us through creating your profile will be included in the file "Registered Users" MedeHX responsibility.
  • The personal information you provide us in order to purchase a product, or your return will be included in the file "Customers" MedeHX responsibility.

As a user, you authorize MedeHX to formalize, in each case, contracts for custom data processing necessary for the proper provision of the Services described in Section "General Conditions" of our Terms and Conditions. We make sure that all those responsible for treatment we work with meet our security policies, maintain safety standards and technical measures imposed by the rules for each data type and follow our instructions in the delivery and proper development of services.

The regulatory authorization for the treatment of the data subject of this document is found in Articles 6 and 9 of Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with that regard to the processing of personal data and on the free movement of such data, articles 6 and 7.6 of the data Protection Act and its implementing regulations, and the Law 41/2002 of 14 November regulating basic patient care and the rights and obligations regarding clinical information and documentation.

1.2. Data collection

As a user of MedeHX, you provide personal information to us through the following ways:

  • When you register, create your profile and access our services, web and platform.
  • When you communicate or actively contact us via the web, our social networks or email.
  • When you make the purchase of any of the products MedeHX offers through the web.
  • When you interact through the website allowing cookies and other technologies described in our Cookies Policy.

We only collect adequate, relevant and necessary data to provide our services and operation of MedeHX, in accordance with the provisions of these Policies Privacy and our Terms and Conditions; the amount of information collected can change based on the data the client adds in each case to their profile.

Please note, in regards to your personal profile,

(i) The MedeHX system provides you with a platform through which, after the corresponding registration and access, can create a personal profile with three sections (hereinafter, the "User Content"):

  • First Aid information: the information you add here is public. It will be accessible both through the QR code that is automatically generated by profile creation by anyone with a reader, and that is to be used predictably in cases of health emergency, that is, for health care or attention of the vital interests of the owner of the profile in the event that the subject is physically or legally incapable of giving consent. Keep in mind that the section is intended to store the information needed to provide appropriate first aid in case of emergency. The data store here are visible in all cases, thus you should not include information that you do not want to be public.
  • Emergency profile: the information you add here is accessible via the id and pin contained in our devices; if device is activated, after the QR code has been scanned, the pin is requested. It is intended to be used in cases of emergency or health care, where necessary for the prevention or the medical diagnosis, the provision of care or treatment or the management of health services, provided that such data processing is performed by a health professional or a person subject to equivalent obligation of professional secrecy. It can also be used for the purposes of care or attention of the vital interests of the owner of the profile in the event that the subject is physically or legally incapable of giving consent. When creating or updating information on your profile, you can decide which information will be visible and which are not, by checking the appropriate checkbox in which you are asked about the visibility of information.
  • Private health information: This section contains the information you choose to include for your own personal consultation or to show it to the person you decide. You will have access to such information, which is protected by your account password.

Within these sections you can enter a series of data:

  • Contact information: Name, Last Name, E-mail, Photo, emergency contact, etc.
  • Clinical data: Blood Type, allergies, medication, etc ... to complete your medical history.
  • Biometrics: height, age, weight, etc.

The visibility of the data on the profile depends on the section you decide to enter information in; (section for First aid information, section for Emergency profile, section for Private Health information), depending on the characteristics indicated in each. Thus, you manage the contents of your private and public profile, selecting in each case the information to be included and visibility of it, and who can access it at all times. You can revoke access any time you wish.

(ii) By registering and accessing our services you declare to know and accept our terms and conditions in an informed, express, freely and unequivocal way:

  • Your MedeHX profile, as well as any other profile, is individual and unique to each person, and access to all the content and editing of information is strictly limited to your as Owner of the Profile by creating a user and an encrypted password. You can create profiles linked to your account, also, for those people whom you have legal representation or you have express authorization to create their profile. You will not create profiles linked to your account on third parties if none of the conditions mentioned in the preceding paragraph is met.
  • Information uploaded in the profiles of MedeHX dependent on your account as indicated in the previous section is truthful, fair and accurate; committing yourself to regular updating it so that the information contained in these profiles correspond at all times with reality. As a user, you acknowledge, understand and agree that by your own vital interest or the holder's profile is essential that the information is updated and appropriate to the situation of the subject of the profile.
  • That, on the basis of the nature of MedeHX service, we recommend to add to your profile sufficient information to ensure appropriate assistance is provider to the holder of the profile in case of emergency by health and firs aid professionals.
  • That, in accordance with the provisions of the current Terms and Conditions, User Content that you upload on First aid information section and Emergency profile section (hereinafter, the "public profile sections") are public; they may be visible by any third party that can read the QR code or access it via the id and pin on the device linked to your emergency information. Please do not include in these sections information you do not want to be known publicly. MedeHX is not responsible for the consequences arising from the inclusion of certain information in your profile or other information you disclose through these sections regarding the User Content. Despite the protection of QR code with Pin and ID, the information you enter on public profile sections is considered public. On the other hand, the information you enter in configuration space of your account, is always confidential, so access will be limited to yourself as a user and the people whom you choose to communicate your access data with.
  • That, by the characteristics of the services we provide, if you do not provide any of the data needed to deliver them, we can not guarantee that you can access all the features of MEDEHX. We indicate in each case on our website and online store the information needed for the proper provision of our services.
  • That, by the characteristics of the services we provide, anyone with QR code reader and access to your MedeHx device can access your public profile from anywhere in the world. Therefore, you expressly consent to the international transfer of your data from our servers for treatment in case of emergency to other countries, including those who are not members of the European Union. This feature is invaluable when we travel abroad, since it can contribute to access your emergency information in any language, allowing saving your life in case of an emergency abroad.

1.3. Treatment of Data, Nature of service and Purpose of treatment

MedeHX aims to provide an online health platform to store your medical records and have them available when needed,

  • because you want to use the information you have stored on the platform and share it with anyone.
  • in order to help prevention or medical diagnosis, the provision of care or treatment or management of health services, provided that such data processing is performed by a health professional subject to professional secrecy or by persons subject to equivalent obligation of secrecy;
  • or for obtaining medical treatment or first aid help, assuming that your are physically or legally unable to give consent, and you have active, one of our devices link to your emergency profile.

In addition, MedeHX also offers devices to link to user’s profiles through QR code, key and password, for sale online. All material published and offered for purchase on the web is part of the business of MedeHX. These activities are designed along these Policies and Privacy Terms and Conditions as the "Services".

Based on the features of the Web that you use, the treatment of the data may be exclusively for the following purposes:

i. Development, implementation and execution of the Services MedeHX provides, in accordance with the provisions of the preceding paragraphs.

ii. Development, implementation and execution of the contract of sale of the products you have purchased or will purchase;

iii. Respond to your request for information;

iv. Provide information about products MedeHX, as well as on related purchases you have made through the website, sending commercial communications by e- mail or any other means of electronic communication or through social networks in relation to such products. You can cancel any subscription services at any time through our website by accessing your account under "My Account" or in business communications.

MedeHX does not process personal data collected for other purposes than those specified herein. The data collected in each case by the website, applications and devices are only adequate, relevant and necessary for the provision of our services, emergency, medical, biometric and commercial, according to information in each case the customer wants to add or necessary to formalize the service/product purchase, inline with the Terms and Conditions herein.

In any case, the processing of data for the purposes described will involve the transfer of data from the user, although, in accordance with state and regional regulations of health and data protection laws, institutions and public and private health centers and doctors or legally authorized professionals can access the processing of personal data relating to the health of people that they attend or have to be treated in them and are included in the emergency profile, always under the conditions and within the limits set forth by the regulation.

MedeHX may communicate data to judges and courts, when necessary to resolve an emergency in accordance with these Terms and Conditions, or when requested by a competent authority, provided that there is a social or universal general interest or particular interest of the affected. Whenever possible and not contrary to the very nature of the service (e.g. on the public part d Profile), MedeHX seeks the anonymity of the users concerned.

1.4. Storage and Data Retention

MedeHX retain data only as long as the user is register to the platform. The data that the user erase from the system will not be stored, except those required for compliance with applicable legal obligations by MedeHX, data will be stored only for the time required by applicable law.

In accordance with Law 41/2002, for the proper functioning of emergency services enabled through the platform, we inform you that by registering on our website, you expressly agree that your personally identifiable information or personal data are stored and organized together with the data of clinical character you decide to enter in the First aid information section and Emergency profile section, which are subject to security indicated in these Terms and Conditions and the current legal system.

1.5. Data security

We take safety measures in the treatment of the data collected for each case and implement security measures define by current regulations. We keep the data in good condition, ensuring its safety, proper storage and, where appropriate, recovery; except that, for technical reasons, force majeure, or beyond our reasonable control, as we have stated in the terms and conditions.

  • MedeHX’s servers: Our servers are located within the European Union, and comply with all mandatory safety instructions imposed by national and international regulations. Also, as a processor, the company managing the server meets all the instructions provided by MedeHX and keeps our same level of security throughout its system and for all our data.
  • Cards and devices offered and sold by MedeHX through the online store: these elements contain, from the time of activation, a direct link to your personal emergency information and therefore, we strongly recommend you to keep it in a safe place, only allowing access to them in case of emergency, keep information in your public profile away from unauthorized access and unwanted consultations. In case of loss or theft of any of these items, you can proceed immediately to deactivate the device by disabling the link that redirects to your information in your personal profile; you can disable the device via your user name and private password from any Internet-connected device.

1.6. Rights of Users

You can freely exercise your rights of access, rectification, deletion, limitation and opposition to the processing of your personal data under the conditions indicated in the relevant regulations by email at: contact@medehx.com, indicating in the subject the right you want to exercise and enclosing your contact details and legible photocopy of your ID.

Also, in case you want receive information by non-electronic means; please let us know in telematics communication or request provided.

We inform you that, in accordance with current legislation, you can complain to the competent control authorities in the event you consider that we have not met or properly implemented privacy policies contained herein.

1.7. Confidentiality

Access to User Content embedded in user profile is protected by user and password; ID and Pin and QR reader, provided the latter for access to certain information in cases of medical emergency.

Therefore, access is intended for the owner of the profile, authorized personnel with access information, predictably professionals who have to perform emergency treatments or third parties legitimately authorized under the provisions of current regulations. There is, in accordance with the aforementioned regulation (Law 15/1999 and 41/2002), an obligation to keep medical secrecy of all User Content, confidential information can not be transferred to other users or used for any other purpose allowing identification of users or their contents.

The aforementioned confidential information may be used for statistical and analytical purposes anonymously and service improvement. MedeHX staff cannot access the confidential information referred to in aggregate form, because it is being protected by the encrypted password, preventing unauthorized access to profiles.

1.8. Disclaimer

We are not responsible for inaccurate or false data uploaded or introduce by the users. Each owner of an account or legal representative with sufficient power is responsible for the information he or she decides to incorporate in the personal profile; being aware and accepting that, by the very nature of our service, uploading or introducing false, inaccurate or imprecise information can impact the functionality of the service and can lead to receive incorrect or deficient first aid help from emergency services; risking you well being and your life or the life of others. Such action can constitute a criminal or civil offense and a breach of this Terms and Conditions.

MedeHX does not control or manage any Profile or User Content, or assume any responsibility for the information provided in the profiles, or for loss or damage caused by the User Content.

2. USE OF COOKIES

In compliance with Article 22.2 of Law 34/2002 of 11 July, services of the Information Society and Electronic Commerce, we inform you that the Web will only use storage devices and data recovery ('Cookies') when the user has given his consent, according to what is stated in the pop - up user's browser when you first access the web, and the Terms and Conditions that every user should know.

Our Cookies Policy aims to help understand the use of cookies, the purpose of the cookies used, and the possible options the user has to manage them. The published policy is subject to periodic updates.
